Federal Court Mandates Freedom of Kilmar Abrego Garcia from ICE Custody
A court has ordered the prompt discharge of Kilmar Abrego Garcia from immigration custody, concluding his ongoing confinement is without legal authority.
"Since Abrego Garcia's release after erroneous detention in El Salvador, he has been taken back into custody, again without lawful authority," the judge stated in her order.
The case originates in a erroneous removal to El Salvador earlier this year, which the government later acknowledged was an error. Following his return to the United States to answer alien smuggling allegations, he was held in immigration custody.
In her decision, the judge noted that the authorities lacks a current deportation order, which prevents them from deporting Mr. Abrego Garcia "for now."
